If you stay at a The Residence 053 hotel or restaurant (?The Residence 053?) apply for a job or work at The Residence 053, The Residence 053 will process your personal data. In this privacy statement (the ?Privacy Statement?) we explain which personal data of applicants and employees are processed, for what purpose and how you can exercise your privacy rights. In addition, you will also find other relevant information in the context of personal data.

The Residence 053 values your privacy. We therefore process your personal data with care and comply with applicable laws and regulations.

1. Applicability of Privacy Statement

The Privacy Statement applies to all activities and actions of The Residence 053 related to applicants and employees. Appendix 1 This Privacy Statement contains a list of the hotels and restaurants covered by this Privacy Statement.

The Residence 053 informs applicants and employees about the processing of personal data, including via vacancy websites, web pages and various (digital) employee platforms. In addition, a new employee is referred to this Privacy Statement when entering into an employment contract.

2. What is the purpose and basis of the processing?

The Residence 053 processes different types of personal data, for different purposes. Below is an explanation of which personal data is processed for which purposes.

1. Recruitment and selection of candidates

The Residence 053 processes personal data in the context of an effective and efficient recruitment and selection process of new employees. The processing takes place with your consent by sending your CV and motivation letter, as well as because we have a legitimate interest in this (recruitment and selection of personnel).

1. Personnel administration

As an employer, The Residence 053 maintains a personnel administration for the registration and updating of personnel data. We do this in the context of personnel management. This concerns data that is necessary for the execution of the employment contract and that must be recorded on the basis of a legal obligation.

1. Payroll and time administration

For the payment of salaries, The Residence 053 maintains a salary and hours administration. This concerns processing that is necessary for the execution of the employment contract and for which The Residence 053 is also legally obliged.

1. Absence registration and policy

The Residence 053 keeps track of its employees' absenteeism as part of its payroll administration, as well as for the prevention of absenteeism and to promote reintegration. These processes are necessary to comply with legal obligations and are necessary for the performance of the employment contract. The Residence 053 distributes newsletters and relevant personnel information to employees via e-mail. We collect your e-mail address in order to share these newsletters and information with you with your permission.

3. What personal data does The Residence 053 process from applicants?

The Residence 053 will process the following categories of personal data:

1. identification and contact details such as title, name, address, place of residence, date of birth, email address and telephone number and any employment documents;
2. training and application data such as CV, motivation letter, training courses, assessments, references;
3. interaction data such as IP address, surfing behaviour on the websites of The Residence 053, click behaviour, cookie ID and contact with The Residence 053; and
4. other data that you voluntarily and additionally provide to us, such as a photo, information about your interests, hobbies and other.

1. identification and contact details such as title, name, address, place of residence, date of birth, e-mail address, marital status, telephone number and any employment documents;
2. training and application data such as CV, motivation letter, training courses, assessments, references;

4. proof of identity and citizen service number;
5. clothing and shoe size;
6. salary data, payroll tax form, time registrations, short-term and long-term leave, absenteeism and other data relevant to payroll administration;
7. data relating to your functioning;
8. interaction data such as IP address, surfing behaviour on the websites of The Residence 053, click behaviour, cookie ID and contact with The Residence 053; and
9. other data that you voluntarily and additionally provide to us, such as photos, information about your interests, hobbies and others.

5. To whom does The Residence 053 provide personal data?

The Residence 053 only provides personal data to other parties to facilitate and enable the processing mentioned under point 2. Below you will find an overview of (the categories of) recipients.

1. the relevant branch where you are applying;
2. (IT) service providers and software companies;
3. enforcement authorities such as the police, judiciary or anti-fraud organisations;
4. the Occupational Health and Safety Service;
5. the UWV;
6. the payroll administrators and controllers of The Residence 053.

In addition, The Residence 053 may share personal information to:

– comply with applicable laws and regulations;

– to respond to government requests or court orders;

– to comply with valid legal procedures;

– to safeguard the rights, privacy, safety or property of The Residence 053, guests or employees;

– to respond to an emergency.

We ensure that data is only shared if the third party processes the data based on our instructions, takes sufficient appropriate (security) measures and guarantees that it will comply with the applicable privacy laws and regulations.

6. Transfer of personal data outside the EEA

The Residence 053 may transfer personal data from the Netherlands to foreign countries. When personal data is processed by us outside the EEA, we will ensure an adequate level of protection of the transferred data. 3. Marketing – cookies that allow us to offer relevant, customized content. This includes relevant offers and information about our services and services. Van der Valk uses Google Analytics. The last part of the IP address of the website visitor is masked. We do not share any other data with Google via Google Analytics.

8. How long does The Residence 053 store personal data?

The Residence 053 does not store personal data for longer than necessary for the purposes stated above, unless there is a legal obligation to store the data or you have given permission for the retention period.

Applicant data will not be used for longer than four weeks after completion of the application procedure, unless you give permission for a longer retention period.

9. Security and measures

The Residence 053 applies a high level of security to data of applicants and employees. The Residence 053 takes appropriate organizational and technical measures to guarantee confidentiality and availability, as well as to prevent unlawful processing of personal data. Access to data by employees of Van der Valk takes place on the basis of necessity given the function of the employees concerned (Need to know principle). The Residence 053 periodically tests the security of its data processing and underlying IT systems. In the event of outsourcing of data processing processes to third parties, we make agreements with these parties about adequate security of the personal data. The measures taken are in line with applicable privacy laws and regulations. However, absolute (100%) security of personal data cannot be guaranteed. If, despite the security measures taken, a security incident occurs, we will take measures to limit the consequences for your privacy as much as possible.

10. Liability

In view of the above under point 9, The Residence 053 cannot be held responsible or liable for unauthorized, unauthorised or unwanted processing and/or access to personal data that cannot be attributed to The Residence 053. We are also not responsible for the actions or omissions of third parties with whom we collaborate or to which we refer on our website(s) or otherwise. The third parties in question are not covered by this Privacy Statement and we therefore recommend that you carefully read the privacy statements of these third parties on the websites. In all the aforementioned cases, The Residence 053 accepts no liability and an applicant or (former) employee is not entitled to compensation, performance or any other claim against The Residence 053.

11. Your privacy rights

As an applicant or employee at The Residence 053, you can request access, correction, deletion, objection, limitation or transfer of personal data. In addition, you have the right to withdraw any consent granted. Any withdrawal of your consent will not affect previous processing based on it.

1. Right of access

You have the right to ask The Residence 053 whether we process personal data of you. If we process data of you, you have the right to inspect the relevant personal data, the purposes of the processing, any sources or recipients of this personal data and the retention period.

1. Right to rectification

If it becomes clear that the data is incorrect, you can submit a request to have it corrected.

1. Right to erasure

You can request us to delete personal data collected about you in the following cases:

• the personal data are no longer necessary for the purposes for which we collected or otherwise processed them;
• if the consent on the basis of which the processing takes place has been withdrawn by you;
• the personal data are processed unlawfully by us;
• we must erase your personal data on the basis of a legal obligation;
• We have collected your data through mobile telephony or internet services.

1. Right to restriction

If you have reported an inaccuracy in your personal data to us or if you have objected to the processing, you can request us to restrict the processing while we are processing your request. You can also request us to restrict the processing if you believe that we are processing your data unlawfully or no longer need it for the processing purposes and you need it for a legal claim.

1. Right to portability

If the processing takes place on the basis of your consent or the processing is carried out via automated procedures, you can request us to transfer your personal data to you. You can also ask us to transfer this data directly to another controller.

1. Right to object

You have the right to object at any time to the processing of personal data relating to you. This applies in particular to profiles that we have created based on your personal data or if we use your personal data for direct marketing purposes.

Exercising rights

If you wish to exercise one or more of the rights listed above, you can do so only by sending an email to the email address of the hotel concerned (see Appendix 1 to the Privacy Statement). Your request must meet the legal requirements. We may require you to identify yourself before we process a request. The Residence 053 will inform you of its decision within four weeks, unless we inform you within that period that we need more time.

Please note that The Residence 053 may refuse to comply with your request in whole or in part under certain circumstances or on the basis of applicable (privacy) laws and regulations.

For other questions, comments or complaints about the processing of personal data, please contact the relevant Hotel. You will find these contact details in Appendix 1 to the Privacy Statement. Please clearly indicate in the subject that it concerns privacy and which request it concerns so that we can respond within the applicable terms. If desired, you can also start a complaints procedure with the Dutch Data Protection Authority. This authority is authorized to take cognizance of your complaint and may decide to further handle the complaint.

13. Changes to the Privacy Statement

The Residence 053 may make changes to the Privacy Statement. Changes to the Privacy Statement will be announced directly via the websites listed in Appendix 1 and are immediately, integrally and fully applicable to the privacy policy of The Residence 053. The Residence 053 therefore recommends checking regularly for changes.

14. Applicable law and competent court

The Privacy Statement is subject to Dutch law. Any disputes between parties will be submitted exclusively to the competent judge of the court of Midden-Nederland.
